Nurenberg, Paris, Heller & McCarthy and Groth & Associates filed a lawsuit on behalf of eight individuals against M.C. Tank Transport and its parent company, The Kenan Advantage Group, over the October 20 chemical release in North Toledo, case CI2026-04646. The firms announced the filing on November 3, 2026, according to PR Newswire.

Nurenberg Paris Alleges Safety Failures in GMA Transfer

The complaint, filed by Nurenberg Paris attorneys Jordan Lebovitz, Jeff Heller and Molly Ebraheim, alleges the defendants failed to follow proper safety procedures while transferring glycidyl methacrylate, or GMA. It alleges heat applied during the transfer set off a chemical reaction that released GMA into the air for nearly 48 hours. The complaint further alleges Kenan failed to provide adequate safety oversight, training and procedures despite a history of federal safety citations.

GMA is a highly flammable industrial monomer used in plastics, paints, coatings and adhesives, and the World Health Organization's cancer research agency classifies it as a probable human carcinogen. The complaint states that victims of the exposure, especially those within a close radius of the leak, have experienced intense skin and eye irritation, nausea, vomiting, headaches and sore throats.

"For nearly two days, a chemical poured into the air over North Toledo," Ebraheim said. "Families at home, workers on the job, and travelers just passing through all breathed it in, and now they are forced to live with the fear of what this chemical may do to their health years from now."

The lawsuit seeks to hold M.C. Tank Transport and The Kenan Advantage Group accountable for harm to North Toledo residents, workers and travelers. Nurenberg Paris and Groth & Associates said anyone who believes they were affected by the October 20 release can contact the firms for a free, confidential consultation. Nurenberg Paris states on its website that it has represented injured Ohioans since 1928.
