Elite Sports Apparel has entered administration as the Australian Taxation Office moves to wind the business up, with Mitchell Ball and Gavin King of insolvency firm Mackay Goodwin appointed joint administrators. Mackay Goodwin's Ball and King Take Control
Ball told SmartCompany that the company is facing action from the tax office. "There are ATO winding-up proceedings afoot," he said. The Australian Taxation Office is the creditor behind the proceedings, and the amount of tax debt owed has not been disclosed.
Ball said the administration is still in its early stages, and he expected to have more information about the company's financial position next week. The company's future is uncertain at this stage, although Ball said its director is exploring options to avoid liquidation.
"The director is considering a Deed of Company Arrangement at the moment to get more money back to the creditors, faster than they normally otherwise would in a liquidation," he said. A Deed of Company Arrangement is a legally binding agreement between a company and its creditors that can provide an alternative to liquidation, potentially allowing the business to continue trading while addressing its debts.
Ball said the company's future could also include the sale of its assets or a restructuring proposal from a third party. "Continuity of the company is either through a DOCA or somebody buying them out, whether through an asset purchase or another party proposing their own DOCA," he said.
Elite Sports Apparel has supplied custom sports uniforms and workwear since 2013, according to its own announcement. The Australian-based business has manufacturing operations in Condell Park, in Sydney's southwest, where it prints, cuts and sews garments in-house. The company also offers embroidery, screen printing and digital fabric printing services and has offices in New Zealand and Fiji. Elite Sports Apparel has marketed its Australian manufacturing as a faster alternative to overseas production. The number of employees affected, debts owed and fate of outstanding orders remain unclear. Ball said the administrators would seek to maximise returns to creditors, although the extent of any repayments remains unclear at this early stage. Elite Sports Apparel declined to comment when contacted by SmartCompany.
