The cases, consolidated in the U.S. District Court of Southern Indiana, have accumulated over roughly a decade.\n\n## Cook Medical's Filter Litigation and FDA Clearances\n\nCook Medical makes the IVC filters at issue, devices intended to catch blood clots before they reach the lungs. Plaintiffs say the filters tilted, fractured and migrated inside their bodies, with legs puncturing veins and internal organs such as the intestines, kidney, liver, spine or heart. Some lawsuits say the filters caused the patient to die. Cook says its products are safe, effective and life saving for those at risk of pulmonary embolism.\n\nIn a statement to IndyStar, Cook said 3,000 cases have been dismissed. The company did not address how many cases have been settled or the status of the remaining 2,000 cases. A Cook spokesperson blamed the volume of lawsuits on a \"significant attorney advertising campaign\" and said other blood clot filter manufacturers have also been sued.\n\n\"The mere fact that there is ongoing litigation,\" she said, \"does not mean that Cook's IVC filters are defective. On the contrary, many of the plaintiffs' treating physicians in the litigation have credited Cook's IVC filters with saving the lives of their patients.\"\n\nIndyStar found that the U.S. Food and Drug Administration repeatedly cleared Cook's devices despite labeling recalls and thousands of adverse event reports. The FDA cleared the filters under a process that allows devices to be authorized based on similarities to other commercially distributed devices and lets companies self-report safety testing. Doctors who study medical device regulation told IndyStar the cases represent failings of a regulatory shortcut with little transparency and oversight.\n\n## Earlier Reporting on Cook Medical\n\nOn October 21, 2026, [Yahoo](https://www.yahoo.com/news/us/articles/oklahoma-tribal-leadership-fight-puts-170309767.html) reported that Cook Medical's filters face more than 11,000 lawsuits consolidated in Indianapolis, alongside more than 4,000 adverse event reports. The same day, The Indianapolis Star reported that Melvin Barrows, an Indiana pastor, died in 2015 after a Cook Medical blood clot filter failed to prevent a clot, and that his family filed a wrongful death lawsuit. Yahoo also reported that Cook Medical, founded in Bloomington in 1963, employs more than 12,000 people, including about 7,000 in Indiana, and has spent more than $450,000 on lobbying since 2021.\n\n## Other Legal Disputes in the Sector\n\nOn October 28, 2026, [The National Law Review](https://natlawreview.com/article/one-call-all-it-takes-fulton-bank-suffers-tough-loss-tcpa-class-action-and-there) reported that a court denied Fulton Bank's motion to compel arbitration in a TCPA class action, ruling the arbitration clause did not cover a marketing call. [Crypto Briefing](https://cryptobriefing.com/xai-offers-buy-mississippi-homes-lawsuit/) reported the same day that xAI's subsidiary MZX Tech is offering to buy homes in Southaven, Mississippi, contingent on sellers releasing claims in a noise lawsuit, targeting 418 homes. [Yahoo](https://www.yahoo.com/news/us/articles/still-claim-dr-squatch-class-134341884.html) reported that consumers have until November 27 to submit claims in the $9 million Dr. Squatch class action settlement, with a final approval hearing set for March 2.\n\n## Cook Medical's Insurance Suit and Pending Cases\n\nCook Medical is suing its insurer over a $10 million insurance policy it wants to use to cover legal costs and potential settlements tied to the blood clot filter lawsuits. That lawsuit is also pending. Some plaintiffs in active cases have died waiting for their claims to be litigated, and family members or estates have stepped in as plaintiffs on their behalf.\n","publisher":{"name":"News for Agent","url":"https://newsforagent.com"}}
